THE FOLLOWING IS NOT TO BE PRINTED WITH THE FINAL OFFICIAL RULES
    Important Information & Promotion Disclaimers
Please note that while the following recommendations and abbreviated rules are generally
acceptable, we recommend SweepstakesPros review the materials on which these will be placed
    to ensure proper compliance.
    Legitimate Business Requirement
Promotions law requires that sweepstakes be an advertising tool for a "bona fide" business, product, or
service that has stand-alone value. A promotion cannot be the business itself. A product or service is not
considered bona fide if its primary purpose is to sell sweepstakes entries, such as "golden ticket"
packages, memberships that only grant extra entries, or merchandise priced far above its fair market
value. And a free method of entry does not cure an offering that is otherwise non-bona fide.
Practical Test: We recommend sponsors apply this simple test: If the sweepstakes were removed
entirely from your website and/or marketing, would your products or services still reasonably sell on their
own at the stated price? If not, revise the offer.
    Examples:
 Overpriced Merchandise: A product priced grossly above its value (e.g., a $500 t-shirt). This may
be viewed as a disguised entry fee, creating an illegal lottery.
 Entry-Focused Memberships or Digital Products: Offering memberships or digital items where the
primary benefit is receiving sweepstakes entries. A webpage that heavily promotes the number of
entries you receive, while only vaguely mentioning an included "digital product," is a significant
red flag. A membership must provide tangible value separate from the promotion.
Ask yourself: Would a customer reasonably purchase these items if no sweepstakes entries were
    included?
    Free Methods of Entry
U.S. Promotions law requires that if your sweepstakes has a method of entry that requires consideration,
we must also offer an equivalent free method of entry, also known as an alternate method of entry (or an
AMOE). Consideration means a payment or any significant effort in order to earn such entry. The free
method of entry must give an equal number of entries into the same drawing for the same prizes as the
method of entry that requires consideration. In order to accomplish this SweepstakesPros must evaluate
all of your methods of entry and calculate an equivalent number of entries for the AMOE. If a method of
entry requires payment, such as purchasing a product, we rely on our clients to provide accurate metrics
or estimates of their sales and the number of entries earned for each purchase method, including any
bonus entry methods. We then calculate an equivalent number of entries for the AMOE and we often
create limits or a maximum number of entries that can be earned per entrant. Therefor you must provide
us will all methods of entry, accurate purchasing estimates, and the frequency and level of bonuses that
will be offered. We are not responsible for information you do not provide to use or for inaccurate
    information you may provide.
Websites & Mobile App Required Terms

How to bind entrants to official terms or rules. In 2014 the Ninth Circuit Court of Appeals ruled that
providing a hyperlink to Terms of Use alone, even if it is near the "Submit" button, is insufficient to bind
consumers to such terms under contract law. Companies must provide a notice or prompt users to take
affirmative action to agree to such terms.
Therefore, to bind entrants to the official rules (on websites, mobile apps, etc.) you must have an express
statement obtaining affirmative consent to the terms of the official rules. Our recommendation is to have a
required opt-in checkbox statement (not pre-checked) on the entry form, order form, or in the cart above
the checkout button (if purchase is an entry method), and on other methods of entry (ideally at the point
where you are collecting consumers' personal information) which binds entrants to the Official Rules, your
Privacy Policy, and any other required terms. For example:
 I agree to the terms of the Official Rules and Privacy Policy.
    or
 By checking this box, you confirm that you have read, understood, and accepted the Official
Rules, Privacy Policy, and Terms and Conditions.
If you cannot have a check box, the next best option is to have a statement right above the submit
button (not under the button) on the form, such as:
By submitting this information, I agree to be bound by the terms of the Official Rules and Privacy
    Policy.
    or
By clicking on the "Submit" button below, you agree to the terms of the Official Rules, Privacy
Policy, and our Terms and Conditions.
Note that all the underlined words above should link to their respective terms. Also note that if you have
Purchase Terms, Terms of Use, etc. for your website, we also recommend including these in this
statement if you do not have consumers opting into these terms elsewhere.
    Abbreviated Rules
The following abbreviated rules are to be printed clearly and conspicuously (meaning that it must be
legible without aid and printed on a contrasting background) on all materials and ads which mention the
promotion and/or prizes, such as ads, social media posts, emails, and the home/landing page and the
entry pages on the promotion website (note additional disclaimers may be required depending on the
type of ad). All capitalization and bold fonts, if any, must be maintained.

Online Advertising & Social Media Guidelines
Online ads and social media posts that mention a sweepstakes or contest, a prize, or a chance to win
should adhere to the following guidelines:
    1. SweepstakesPros should review your ads and posts to ensure that they contain copy and
creatives that are consistent with the promotional offer, your official rules, and applicable
    promotion laws and guidelines.
    2. The above abbreviated rules should be included in each ad or social media post unless the
amount of mandatory legal language that can be reasonably included in ad or post is limited due
to size. If this is the case, and the abbreviated rules cannot be reasonably displayed in the ad or
post the abbreviated rules must be available within one click, in other words on the 1 st page that is
displayed after the ad/post is clicked.
    3. The landing page displayed after a visitor clicks on an ad or post should include, at a minimum,
the abbreviated rules (and the abbreviated rules must include the link to the full official rules).
Therefore, all digital ads and posts should link to the full Official Rules within two clicks, if the
abbreviated rules cannot be included in such ads and posts.
    4. Recommendations for Instagram and TikTok posts. If you are posting on these platforms and you
do not have enough room to display the abbreviated rules in the image/video itself, then you may
put the abbreviated rules in the caption of the Instagram post or in the description of the TikTok
post. When the post is viewed the caption/description may be viewed with at most one click on a
“more…” link. This means that the abbreviated rules may be read with only one click.
    5. Recommendations for Facebook and X posts. Free X accounts may have a limited number of
characters allowed in each post. Facebook accounts and paid X accounts allow significantly
higher limits. If you have not reached the character limits for each post, we recommend including
the abbreviated rules in your posts.
Online Video & TV Commercial Guidelines
Videos/TV Commercials that mention a sweepstakes, contest or prizes should adhere to the following
    guidelines:
    1. SweepstakesPros should review each video to ensure that it contains copy and creatives that are
consistent with the promotional offer your official rules, and applicable promotion laws and
    guidelines.
    2. The abbreviated rules above should be displayed clearly and conspicuously in the video
(meaning that it must be able to be read without aid, displayed on a contrasting background, and
on screen long enough to be read). All capitalization and bold fonts, if any, in the abbreviated
    rules must be maintained.
    3. Additional abbreviated rules recommendations:
 We recommend that the abbreviated rules be displayed at the end of the video for a
    minimum of 4 seconds.
 The abbreviated rules should be fixed and should not scroll.
    4. If a video will only be displayed in a post on Instagram or TikTok, and the video is not accessible
via any other method, then instead of adding the abbreviated rules to the video, you may put the
abbreviated rules in the caption of the Instagram post or in the description of the TikTok post.
When the post is viewed, the caption/description may be viewed with at most one click on a
“more” link. This means that the abbreviated rules may be read with only one click.

© Pacific Digital Industries, Inc. d/b/a SweepstakesPros. All rights reserved. (ver. 20251029) 13
    5. If a video will only be displayed on the promotion website, and the video is not accessible via any
other method, then instead of adding the abbreviated rules to the video, you may put the
abbreviated rules on the page that is hosting the video (ideally near the video).
Point of Sale Materials Guidelines (for Retailers, NOT for Product
Manufacturers, when entry is required in-store)
SweepstakesPros recommends that the full Official Rules be printed on at least one of the supplied POS
materials that will be available in-store throughout the promotion period. This avoids any
confusion/questions by the consumer and satisfies any state disclosure requirements. To assume that a
Store Manager or backroom personnel will properly post a set of Official Rules at the customer service
desk in today's employment and store environment is questionable. We do not believe it will happen
consistently store-by-store in a given chain. Therefore, including the full rules printed on the supplied POS
materials ensures that the full rules will always be available. However, if you choose not to follow this
recommendation, you should at least include a copy of the full Official Rules and clear instructions
requiring each retailer to post the rules at their customer service desk for the duration of the promotion.
The instructions should include the specific dates of when the rules should be posted and brought down.
Note that the following recommended legal text must be clear and conspicuous (meaning that they must
be able to be read without aid and printed on a contrasting background). Please be sure that the legal
language is large enough to read without aid.
In-Store Materials: counter card, flyer, poster, etc.
    1. SweepstakesPros recommends including the full Official Rules on the back of any material with
the front of the material saying, “NO PURCHASE NECESSARY. SEE BACK FOR DETAILS."
If this recommendation is followed, the other display materials can simply say, "NO PURCHASE
NECESSARY. SEE COUNTER CARD FOR COMPLETE DETAILS" (assuming the counter card
has the full rules printed on them) Also, if a tear pad is attached to a display, the display
containing the tear pad would not need any disclaimer since the tear pad is part of the display.
    2. If you are NOT able to follow our recommendation and print the complete rules on the back of the
in-store materials, SweepstakesPros recommends including the following on these materials. All
capitalization and bold fonts, if any, must be maintained.
    * * * LIMIT OF FIFTEEN THOUSAND (15,000) ENTRIES PER PERSON/EMAIL ADDRESS. *
    * * NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT
IMPROVE YOUR CHANCES OF WINNING. The JK Boots Ford Raptor Giveaway #2 is open
only to legal residents of the 48 contiguous US States & DC (excluding NY, FL, AK & HI) who
have reached the age of majority +. Void elsewhere and where prohibited. Winner of vehicle
must pick up vehicle from a location in Washington, USA, designated by Sponsor and
participate in prize-related activities. To enter, visit and purchase products priced at $30 or
more at a JK Boots store or at www.jkboots.com between 11/01/2025 and 06/30/2026.

store customer service desk or at https://bit.ly/JKBootsRaptor2.

Promotion Materials Delivered via US MaiI or Private Carrier
(Including Notices in Product Shipping Boxes)
Sweepstakes and contest notices sent via US Postal mail are highly regulated under Federal Postal
Regulations. Colorado also has very strict laws governing the delivery of sweepstakes and contest

notices, other than an advertisement appearing in a magazine or newspaper of general circulation,
delivered by the United States postal service or by any private carrier.
Please notify SweepstakesPros in advance if you are planning to send any sweepstakes/contest
materials (or mention of prizes or winning) via the US Postal Service or private carrier (such as FedEx or
    UPS).
Emails Sent to US Recipients Guidelines
When creating an email to send to US recipients for a promotion, please be sure that all creative and
copy is consistent with the promotional offer and includes the following:
    1. In the footer of any email that mentions the promotion or the prizes, include the above
    abbreviated rules.
    2. The full Official Rules must be accessible within 2 clicks.
    3. In order to comply with the Federal CAN-SPAM Act of 2003 and generally accepted email
conventions, we recommend including the following in the email message:
    a. Do not use false or misleading information in the email or headers. Your “From,” “To,”
“Reply-To,” and routing information – including the originating domain name and email
address – must be accurate and identify the person or business who initiated the
    message.
    b. A clear Subject that is not deceptive. The subject line must accurately reflect the content
    of the message.
    c. A clear, easy method for recipients to opt-out of the mailing list. The unsubscribe
mechanism must be clearly displayed, function for at least 30 calendar days after being
used in an email and allow the recipient the option to unsubscribe from all commercial
email from the sender. The recipient should be able to unsubscribe from who appears in
the From Name. The sender must honor all unsubscribe requests made within 10
    business days.
    d. A link to the sender’s privacy policy. Including this link is not required but we recommend
    it as a best practice.
    e. A valid physical postal address for the sender. This can be your current street address, a
post office box you’ve registered with the U.S. Postal Service, or a private mailbox you’ve
registered with a commercial mail receiving agency established under Postal Service
    regulations.
    f. A notice that this email is commercial in nature somewhere in the email. The law gives
you a lot of leeway in how to do this, but you must disclose clearly and conspicuously that
your message is an advertisement. (We suggest including the word ADVERTISEMENT
or SOLICITATION in the message). This is not necessary if all recipients have provided
affirmative (opt-in) consent from the sender.

    Using Trademarks & Tradenames
    SweepstakesPros also recommends the following:
 Remove all trademarked items/names (e.g., Starbucks, Apple, iPad, Amazon, Nissan, etc.) from
all of the promotion materials unless used with express written permission from the brands.

    U.S. Sponsor Tax Obligations
In the United States, prizes awarded in a promotion (whether in the form of cash, merchandise, or
services) are treated as taxable income to the winner, similar to gifts or gambling winnings. A sponsor is
the organizer of the promotion (typically listed as “Sponsor” or “Promoter” in the official rules) that is
responsible for the promotion and for awarding the prizes. U.S. Sponsors must adhere to the following tax
    requirements when awarding prizes.
    Prizes Awarded to U.S. Residents
U.S. winners are required to report all income, including the fair market value of all prizes won, to the
IRS. The amount of tax owed on a prize is based on the winner’s overall income for the year in which
the prize was awarded. Sponsors may also be required to report the fair market value of prizes
awarded to U.S. winners as follows:
 Prizes Valued Under $600. If the total value of prizes paid to a U.S. winner within a calendar
year is under $600, sponsors are not obligated to report the recipient's prize to the United
    States Internal Revenue Service (IRS).
 Prizes Valued at $600 or More. If the total value of prizes paid to a U.S. winner is $600 or
more, sponsors are required to collect the appropriate tax form (typically a 1099-MISC form)
from the winner and report the earnings to the IRS.
Prizes Awarded to Foreign, Non-U.S. Residents
Sponsors must collect the necessary tax forms (typically a W-8BEN from) from all non-U.S. residents
who receive a prize, regardless of the prize's value.
 If the non-U.S. winner entered the promotion while outside of the U.S. and provides a
completed W-8BEN, the sponsor is not required to withhold taxes. However, if a W-8BEN is
not collected from the winner, the sponsor must withhold 30% of the prize's fair market value
and submit that amount, along with the appropriate tax forms, to the IRS.

© Pacific Digital Industries, Inc. d/b/a SweepstakesPros. All rights reserved. (ver. 20251029) 16
 If the non-U.S. winner entered the promotion while inside of the US, the sponsor must
withhold 30% of the prize's fair market value. If the winner submits a W-8BEN and indicates
eligibility for a lower tax rate via a treaty, the withholding may be reduced. The sponsor is
responsible for submitting the withholding amount and the appropriate tax forms to the IRS.
For non-cash prizes (such as trips, merchandise, or services), the sponsor remains responsible for
withholding and submitting up to 30% of the prize's fair market value to the IRS, if withholding is
    required.
